The terms and conditions apply to the use of this website and by using this website you agree to be bound by the terms and conditions set out below. If you do not agree to these terms and conditions you may not use or access this website.

We advise all our customers to carefully read our terms and conditions prior to placing an order, to avoid any inconvenience for either party.

ACCESS TO AND USE OF THIS WEBSITE

When you place an order, or register as a customer, the personal information which you are required to provide must be true, accurate, current and complete in all respects. You must notify us immediately of any changes to the personal information by contacting us by email on emily@mahala.co.uk. For more details on how we collect your personal data and what we do with it, please consult our privacy policy.

 

PRIVACY POLICY

The only personal data stored by Mahala Limited are email addresses of newsletter subscribers. By subscribing to the newsletter subscribers have given permission to be contacted with marketing information via email only in relation to Mahala Limited.

Any email addresses submitted are not shared with third parties.

We do not have access to the IP address of newsletter subscribers or users of the site.

Analytics cookies – In order to keep the website relevant, easy to use and up-to-date, web analytics services are used to help understand how people use the site.

Cookies allow web analytics services to recognise your browser or device and, for example, identify whether you have visited our website before, what you have previously viewed or clicked on, and how you found the website. The information is anonymous and only used for statistical purposes, and it helps to analyse patterns of user activity and to develop a better user experience.

Web analytics data and cookies cannot be used to identify you – they do not contain personal information such as your name or email address.

Social Media Buttons – Mahala.co.uk includes social media buttons to Facebook. Instagram and Twitter. These features may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the feature to function properly. Social media buttons are either hosted by a third party or hosted directly on our website. Your interactions with these features are governed by the privacy policy of the company providing it.

What we collect and store

While you visit our site, we’ll track:

  • Products you’ve viewed: we’ll use this to, for example, show you products you’ve recently viewed
  • Location, IP address and browser type: we’ll use this for purposes like estimating taxes and shipping
  • Shipping address: we’ll ask you to enter this so we can, for instance, estimate shipping before you place an order, and send you the order!

We’ll also use cookies to keep track of cart contents while you’re browsing our site.

When you purchase from us, we’ll ask you to provide information including your name, billing address, shipping address, email address, phone number, credit card/payment details and optional account information like username and password. We’ll use this information for purposes, such as, to:

  • Send you information about your account and order
  • Respond to your requests, including refunds and complaints
  • Process payments and prevent fraud
  • Set up your account for our store
  • Comply with any legal obligations we have, such as calculating taxes
  • Improve our store offerings
  • Send you marketing messages, if you choose to receive them

If you create an account, we will store your name, address, email and phone number, which will be used to populate the checkout for future orders.

We generally store information about you for as long as we need the information for the purposes for which we collect and use it, and we are not legally required to continue to keep it. For example, we will store order information for 5 years for tax and accounting purposes. This includes your name, email address and billing and shipping addresses.

We will also store comments or reviews, if you choose to leave them.

Who on our team has access

Members of our team have access to the information you provide us. For example, both Administrators and Shop Managers can access:

  • Order information like what was purchased, when it was purchased and where it should be sent, and
  • Customer information like your name, email address, and billing and shipping information.

Our team members have access to this information to help fulfill orders, process refunds and support you.

What we share with others

Payments

We accept payments through Squareup. When processing payments, some of your data will be passed to Squareup, including information required to process or support the payment, such as the purchase total and billing information.

PRICES

Goods are charged at price shown on the product pages on the date the customer places the order and are inclusive of VAT (UK). Prices are correct at time of publication. Errors and omissions are excepted. Orders will be processed at our published prices, and we reserve the right to change these at any time without notice. All prices are stated in Pounds Sterling (£ GBP).

 

TERMS OF SALE

By ordering with us you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price. Purchases are charged at the time the order is placed. Once your order has been placed you will receive a confirmation email. This email will only be an acknowledgment and will not constitute acceptance of your order. A contract between us for the purchase of the goods will not be formed until your payment has been approved. By submitting an order through our site, you are confirming that the payment details provided on your order are valid and correct.

All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to, or does not for any reason, authorise payment then you will be notified of this at the check-out stage, or shortly after placing your order

RETURN & REFUND POLICY

If you are not completely satisfied with any items purchased, you can return them to us within 14 days for a full refund or exchange.

Please return unwanted or incorrect items in perfect, resalable condition, including the original packaging for a full refund or exchange.

To return items, please email with your order number and return address.

The Consumer Contracts Regulations 2013 offers you the following cancellation rights when you buy online or by phone:

  1.  You have the right to return your order within 14 days of the date the order is delivered to you.
  2.  You then have a further 14 days from notifying us to return the goods.
  3.  Postage will be supplied for UK returns. A quote for international returns will be provided on receipt of your returns email.
  4.  We will reimburse to you the amount in relation to goods to which cancellation rights apply, via the method used to pay for the original transaction. This does not include Next day or international delivery costs.
  5.  We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you. We will make the reimbursement no later than 14 days after the day we receive back from you any goods supplied.
  6.  Please return your goods to us in the exact condition you received them, including original packaging, to Mahala Ltd, 261 Well St, London E9 6RG, UK

SHIPPING AND DELIVERY

You must provide us with complete and accurate delivery address information. For the avoidance of doubt, this includes not only the address that your Order is going to, but also the name of its recipient. We will not be liable for the delivery of your Order as a result of you supplying us with incomplete or inaccurate information. Parcels may require a signature on delivery. Please note that delivery of your Order may take longer during sale or other busy periods, but you will be notified if this is the case.

Please note, if you choose to use any of our delivery partners’ personalised services (including but not limited to having your parcel delivered to a neighbour or left in a safe place), Mahala shall not be held liable for any items which are lost, damaged or delayed.

We will make every effort to deliver your Order within the estimated timescales. However delays are occasionally inevitable due to unforeseen factors or events outside our control, for example, material shortages, travel or transportation disruption, import delays or higher-than-anticipated demand. Mahala shall not be liable for any delay or failure by us to deliver your Order within the estimated timescales as a result of such delays.

Mahala will only accept shipments to a valid street address. We do not deliver to P.O. Boxes

During the Christmas period, New Year and UK Bank Holidays, it may take slightly longer for packages to arrive. We can not be held responsible for the delay around these national holiday dates and international shipments. Please note that once the order is posted, the parcels are inevitably out of Mahala Ltd’s control and responsibility.

 

Customs, Duties and Taxes

All goods which are sold within the European Union (EU) are invoiced including VAT. For orders from outside the EU (world), the tax and customs legislation of the respective country applies. In this case, prices for goods are calculated without VAT. Additional charges (VAT of the respective country and customs charges) will not be paid by Mahala.

If you are located in a non-EU country, we recommend enquiring about potential customs charges before placing an order. Moreover, we would like to point out that the customs authorities may open and inspect your parcel.

Mahala is not responsible for any customs and taxes applied to your order. All fees imposed during or after shipping are the responsibility of the customer (tariffs, taxes, etc.).

FEEDBACK AND COMPLAINTS

We always welcome feedback from our customers as it enables us to improve our service. If we should receive a complaint about any part of our service, by phone, e-mail, letter, or via social media then it will be dealt with as soon as is possible.

 

LAW

These terms and conditions shall be governed by and construed in accordance with the laws of England and you irrevocably submit to the exclusive jurisdiction of the courts of England.
